Food Marketing Institute’s FOIA Case

U.S. Supreme Court Agrees to Hear Important FOIA Case Brought by Baker Botts on Behalf of the Food Marketing Institute

U.S. Supreme Court today granted a petition for a writ of certiorari filed by the Food Marketing Institute, the firm’s client. The case involves Exemption 4 of the Freedom of Information Act, which protects from disclosure confidential commercial information, and presents the Court its first opportunity to address what data qualifies as “confidential.”

Food Marketing Institute is a trade association of its kind. The Association offers its members a diversity of services that range from helping the small independent operation remain competitive, to assisting wholesalers to develop the latest distribution systems, to identifying consumer attitudes toward food safety, solid waste, new products and the like.
