Dan Fallows, formerly Chief Engineer – Aerodynamics for the Red Bull Racing Formula One team, was involved in a dispute regarding his high profile move to another Formula One team, Aston Martin Racing, to take up the coveted position of Technical Director at the start of April 2022.

Mr Fallows’ move to Aston Martin was announced in June 2021, including by Red Bull who made it clear that they would not release him until July 2023. In October 2021, Red Bull commenced High Court proceedings against Mr Fallows in respect of the dispute. The case was listed for an expedited trial to take place three months later beginning on 24 January 2022.

The parties reached a settlement just days before the matter was to go to trial. Under that agreement, after a short period of gardening leave, Mr Fallows joined Aston Martin on 2 April 2022, a much earlier date than July 2023 as contended for by Red Bull.

The Wallace team was led by partners Daniel Isaac (Picture – Employment) and Alexander Weinberg (Commercial Litigation) with support from commercial litigation associates Elizabeth Asher, Philip Blyghton and Harriet Montgomery and employment associate, Leigh Leach.
