These areas are led by lawyer Joaquín Palma, with the support of partners Juan Eduardo Palma J. in the regulatory area and Paz Palma in the Compliance area, also counting on professionals with training in corporate, international, and regulatory law.
Joaquín Palma is a lawyer and LL.M. with a mention in Constitutional Law from the Pontificia Universidad Católica de Chile, and also holds an LL.M from Columbia University. He is a member of the New York State Bar in the USA and various courts in the Second Federal Circuit of that state, allowing him to practice both in Chile and the United States. He has represented interests before state institutions such as the Ministry of Education, Comptroller General of the Republic, Council for Transparency, Constitutional Court, Securities and Exchange Commission (SEC), Financial Crimes Enforcement Network (FinCen), and federal circuit courts in the United States.
The primary focus of Palma’s Compliance area will be on crime prevention and regulatory compliance, aligning with the Economic and Environmental Crimes Law (N°21.595), the Law on Criminal Liability of Legal Entities (N°20.393), and the recently published labor laws. According to Joaquín, “this practice seeks to strengthen corporate risk management through a comprehensive approach that combines regulatory compliance with the implementation of rigorous crime prevention models. Having robust programs in this area not only mitigates legal risks but also strengthens the ethical culture of the company and improves competitiveness in an increasingly demanding global business environment.”
In this regard, Juan Eduardo Palma J. adds: “It is currently important to consider international regulations such as the UK Bribery Act against corruption and the OECD regulatory frameworks, which establish high standards of corporate integrity for companies with international operations. This becomes even more relevant given the recent temporary suspension of the US Foreign Corrupt Practices Act (FCPA) for 180 days starting February 10, 2025.”
Palma’s Public Law & Regulatory-Free Competition area, meanwhile, will offer representation in contentious-administrative matters, public law nullity, state liability, litigation before the Comptroller General of the Republic, administrative contracting, administrative summaries and investigations, and free competition, among others. This practice seeks to ensure that companies operate within a clear and secure regulatory framework, ensuring compliance with national and international regulations with quality standards and fair competition.
Lawyer Joaquín Palma has extensive experience in regulatory matters both in the private and public sectors, in Chile and abroad. In terms of Compliance, Joaquín has served as a compliance officer, advising various companies on the implementation of crime prevention models, compliance programs, and adaptation to new regulations such as the Economic Crimes Law.
Joaquín focuses his practice on Constitutional and Administrative Litigation, Free Competition Litigation, and representation before state authorities.
He is a professor of Constitutional Law in the LL.M. program at the Pontificia Universidad Católica de Chile and at the Universidad Finis Terrae. Additionally, he is a professor of Economic Law at the same institution. He is a member of the Union International des Avocats (UIA) and recently joined the Corporate Governance and Compliance Advisory Committee of AmCham Chile.
